Proposition 1 would create a broad new statutory right to abortion up to “fetal viability” and beyond in cases of “medical emergency.” That sounds limited. In practice, it is not.

The measure redefines viability as the point when a baby has a “significant likelihood of sustained survival… without extraordinary medical measures.” Opponents note that ordinary care such as oxygen or neonatal intensive care could be treated as “extraordinary,” potentially pushing unrestricted abortion deep into the second trimester—and in some cases later. After that point, the expanded “medical emergency” exception (serious impairment of a bodily function or organ) is far broader than Idaho’s current life-of-the-mother standard.

The language grants this right to “every person.” That raises serious questions about parental consent for minors. Existing safeguards that require a parent’s involvement could be challenged or overridden. It also replaces the longstanding requirement that only physicians perform abortions with the broader term “health care provider,” weakening a basic safety standard.

Idaho already allows abortion when necessary to prevent the death of the pregnant woman and, in the first trimester, in documented cases of rape or incest. Contraception, fertility treatment, and miscarriage care remain legal. Proposition 1 goes much further than restoring limited exceptions. It establishes a sweeping right that courts would be instructed to interpret liberally in favor of abortion access, potentially sweeping aside other common-sense protections.

Idaho values life, parental authority, and careful limits. Proposition 1 moves in the opposite direction. Vote No.
